Three paths through the estate garden

Each service is shaped around the particular circumstances a family brings to us. We do not apply a formula; we listen first.

Why Benih Wasiat

What makes the difference

Families return to us because the process was clear, the documents were sound, and they felt heard throughout.

Focused on Inheritance Law

Our practice centres on estate planning and inheritance matters. This focus means we are familiar with the patterns that arise in family estate situations in Sabah, and we understand the relevant law in depth.

Plain-Language Counsel

Legal documents can be confusing. We take time to explain what each clause means and why it is there. Clients leave each meeting with a clear sense of where things stand.

Documents That Hold

Poorly drafted estate documents cause disputes later. We spend time on the details during drafting so that the documents reflect actual intentions and are less likely to be challenged.

Sensitivity to Family Dynamics

Inheritance matters often touch on long-standing family relationships. We approach each situation with care, and where resolution is possible without litigation, we explore it first.

Secure Record-Keeping

Originals of executed documents are stored securely. Clients receive certified copies and a short note explaining how to locate and use their documents when they are needed.

Based in Sabah

Our office is in Kota Kinabalu. We understand the regional context — family structures, land ownership customs, and the local courts — and we serve clients throughout Sabah.

Questions

Frequently asked questions

Do I need a will if my estate is modest?
Having a will in place — regardless of the size of your estate — means your wishes are recorded clearly. Without one, your assets pass under the rules of intestacy, which may not match what you had in mind, and the administration process can be longer for your family.
How long does it take to prepare estate documents?
The timeline depends on the complexity of your circumstances and how quickly we can schedule the required meetings. For a straightforward will, the drafting, review, and execution can typically be completed within two to three weeks from the first session.
What if family members disagree about the estate?
Disagreements over an estate are handled through our contested matters service. We begin by exploring whether a negotiated settlement is possible, as this is often less taxing on the family and less costly than litigation. If proceedings are necessary, we prepare the matter carefully and keep all parties informed with written updates.
Can I update my will after it has been executed?
Yes. A will can be revised at any time while you have capacity. We can prepare a codicil for minor changes, or draft a new will if circumstances have shifted significantly. We recommend reviewing your estate documents whenever there is a major change in your family or asset situation.
Are my discussions with you confidential?
Everything you share with us is protected by legal professional privilege. We do not discuss client matters outside the office, and all files are kept securely. You can speak openly about your family situation without concern.
What is the first step if I want to begin?
You are welcome to contact us by phone or through our enquiry form. We will arrange a time to speak briefly about your situation, and from there you can decide whether you wish to proceed with a full planning session. There is no obligation to commit to anything at that stage.
