Our Story

A practice built
around the family.

Benih Wasiat was established in Kota Kinabalu to serve the particular legal needs that arise when a family begins to think about what happens after they are gone — and when, sometimes, those plans become contested.

Our Background

Why we do this work

Benih Wasiat — meaning the seed of a bequest — was founded in Kota Kinabalu with a specific purpose: to give families in Sabah access to clear, considered legal counsel on estate and inheritance matters. The name reflects the belief that a thoughtfully planted estate plan can provide for those who come after, in the same way a seed planted with care grows into something lasting.

The firm's founders had seen how disputes arose — not always from bad intentions, but from documents that were ambiguous, from conversations that never happened, from families who had not found a lawyer who would sit with them long enough to understand the full picture. Benih Wasiat was built as a response to that gap.

We are a small practice by choice. We do not take on more matters than we can serve attentively. Each client is known by name, not case number.

Our Mission

What we stand for

Patience over speed

Estate decisions should not be rushed. We hold the pace at whatever suits the client and never create pressure to sign.

Clarity in every document

Ambiguity is the seed of disputes. We draft with precision and explain every clause to the client before execution.

Resolution before litigation

In contested matters, we explore every reasonable path to settlement before proceeding to court, because families often fare better when disputes resolve outside the courtroom.

Our Expertise

Estate law in Sabah — what it involves and why it matters

Inheritance law in Malaysia operates across several frameworks — the Distribution Act 1958 for those without a valid will, the Probate and Administration Act 1959 for estate administration, and a range of trust and nominee provisions that interact with how assets are held. For families in Sabah, the interplay with customary land rights and the particular jurisdictional context of Sabah adds further complexity.

Well-prepared estate documents reduce the likelihood of disputes and make the administration of an estate considerably smoother for the people left behind. A will that clearly identifies assets, named beneficiaries, and the executor's role gives the family a map to follow during what is already a difficult time. When documents are absent or poorly drawn, administrators must apply to the courts and wait — sometimes for years — before distributions can proceed.

Contested estate matters arise for various reasons: a family member may question whether the person who made the will had capacity at the time, or whether influence was brought to bear. Executors may be alleged to have mismanaged the estate. In some cases, assets may be traced to sources not initially disclosed. Our work in contested matters is shaped by a commitment to thorough evidence and a genuine effort to resolve disputes without extending the family's distress unnecessarily.

Benih Wasiat operates from Kota Kinabalu and serves clients throughout Sabah. We welcome enquiries from individuals who are beginning to think about their estate, from families managing the administration of a recently passed relative's affairs, and from those who find themselves facing a dispute over an inheritance.
